1. Service Description
I'm Alive Today is a wellness tool that allows users to check in daily. If a user does not check in for 48 hours, the system sends an SMS to their designated emergency contact.
2. SMS Consent
By using this service, you consent to the following:
- You agree to receive SMS text messages from I'm Alive Today, including check-in reminders and account notifications.
- You confirm that you have obtained consent from your emergency contact to receive SMS alert messages on your behalf.
- Message frequency varies based on your check-in activity. Message and data rates may apply.
- You can stop using the service at any time by discontinuing check-ins or contacting support.
3. NOT a Medical Device
I'm Alive Today is NOT a medical device, emergency service, or healthcare product. It does not:
- Provide medical advice, diagnosis, or treatment
- Monitor health conditions
- Connect to 911 or emergency services
- Replace professional medical care or emergency response systems
4. Best-Effort Service
We strive for reliable service, but technology can fail. Alerts may be delayed or not delivered due to:
- Internet or cellular network outages
- SMS delivery failures
- Push notification issues
- Server maintenance or technical problems
- Third-party service disruptions
We provide this service on a "best effort" basis and cannot guarantee delivery of any notification or alert.
5. User Responsibilities
You are responsible for:
- Keeping your device charged and connected to the internet
- Enabling push notifications for this app
- Providing accurate emergency contact information
- Informing your emergency contact that they may receive alerts from this service
- Checking in regularly as intended
6. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW:
- I'm Alive Today, its owners, operators, and affiliates shall NOT be liable for any damages, injuries, losses, or harm arising from the use or inability to use this service.
- This includes, but is not limited to: missed alerts, delayed notifications, service outages, technical failures, or any consequences resulting from reliance on this service.
- We are not responsible for any actions or inactions by your emergency contact.
- You use this service entirely at your own risk.
7. Indemnification
You agree to indemnify and hold harmless I'm Alive Today and its operators from any claims, damages, or expenses arising from your use of the service.
8. No Warranty
This service is provided "AS IS" without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, or non-infringement.
9. Payment
The service requires an annual subscription ($12.99/year), billed through the Apple App Store. Your subscription automatically renews unless canceled at least 24 hours before the end of the current billing period. You can manage or cancel your subscription in your iPhone's Settings → Apple ID → Subscriptions. Refunds are handled by Apple in accordance with their refund policies.
10. Changes to Terms
We may update these terms at any time. Continued use of the service after changes constitutes acceptance of the new terms.
11. Governing Law
These terms are governed by the laws of the United States. Any disputes shall be resolved in courts located in the United States.
